Virtual Staging and the NAR Code of Ethics (Article 12)
Article 12 of the NAR Code of Ethics requires REALTORS® to "be honest and truthful in their real estate communications and present a true picture in their advertising." For virtually staged photos, that means disclosure: a buyer looking at your marketing should never be misled about what physically exists in the property.
The Law
- Name:
- NAR Code of Ethics, Article 12
- REALTORS® must present a true picture in advertising, marketing, and other representations. Undisclosed virtual staging that misleads consumers about a property's condition can violate Article 12 and trigger ethics complaints.
Requirements & Checklist
- ✓Disclose virtual staging clearly in every medium where the staged image appears — MLS, portals, social media, and print.
- ✓Make sure the staging shows only furniture/décor changes, never condition or feature changes.
- ✓Respond promptly if a consumer or cooperating broker asks for the original photos.
- ✓Apply the same standard to AI-generated renders, twilight conversions, and object removal.
Penalties for Non-Compliance
Ethics complaints are heard by local association professional standards panels. Sanctions range from letters of warning and mandatory education to fines (commonly up to $15,000) and, in extreme cases, suspension or termination of membership.
Frequently Asked Questions
Is undisclosed virtual staging an ethics violation?
It can be. If a hearing panel finds the staged photos presented a misleading picture of the property, undisclosed staging can violate Article 12.
Does a "virtually staged" caption satisfy Article 12?
A clear caption generally satisfies the true-picture standard, but an on-image label is stronger because images are frequently shared without their captions.
